  • ICC is a permanent court to prosecute individual perpetrators of international criminals which include of genocide, crime against humanity, war crimes or other related aggression. Meanwhile, the UN Security Council has the authority to report cases of international crimes that are committed by states or non-state actor in accordance to Rome Statute. The type of crimes committed against Rohingyas in Myanmar is a proof of the case that regulated by Rome Statute. ICC does not have the authority to handle in that particular case due to Myanmar status as non ICC member states. However, Bangladesh is one of the countries that suffers from Rohingyas deportation, in which Bangladesh is a current member of the ICC. Bangladesh has the right to report Rohingya ethnic conflict case in Myanmar to UN Security Council, while lead to UN Security Council writing a formal request to ICC to advance the investigation and court proceedings for the crimes. This research aims to provide an understanding on whether or not Rohingyaethnicconflict can be tried at the ICC. The research is a descriptive qualitative research using the Fact Finding Report, secondary data sources obtained from journals and tertiary data. Based on the Fact Finding Report, ICC has the authority to try individuals who are the perpetrators of crimes against humanity of Rohingyas in Myanmar.
