  • Indonesia is a country with strategic position, which one located between two continents and two oceans that makes Indonesia becoming the path for assylum seeker in Asia to go to developed countries to get asylum. However, Indonesia is not a State party to the 1951 Convention on the Relating to the Status of Refugee and the 1967 Protocol on the Relating to the Status of Refugee. The aim of this study is to find out the authority of Indonesia as a non-participating member of the 1951 Convention on the Relating to the Status of Refugee and the 1967 Protocol on the Relating to the Status of Refugee for the Protection of International Law to the Rohingya Refugees. The results of this study indicate that although Indonesia is not a State party to the 1951 Convention on the Relating to the Status of Refugee and the 1967 Protocol on the Relating to the Status of Refugee, Indonesia remains obliged to provide assistance and protection to Rohingya Refugees who came to Indonesia.
