- Waqf as part of the discussion on the economic field has a very big role in resolving the problem of poverty, especially since the economic crisis. Waqf is a container in the normative process in Islam understood as a religious institution or institution that is useful in addition to other money institutions. Like zakat, infaq and alms. Waqf is one of the deeds of worship which is special, this is because the endowments will continue to flow even though we have died in the world. This information is based on the hadith of Rasullulah S.A.W, if a person dies, his deeds are interrupted, except for three things, alms finger, useful knowledge, and pious children who always pray for him. However, if it is associated with mortgages, the mortgage is intended to guarantee the repayment of the debt when the debtor defaults on the legal obligation to pay the debt. While waqf is not for specific purposes in relation to debt, and the endowment object is forever used for religious and social purposes. The subject matter raised in the thesis with the title "Land waqf legal review in terms of law number 41 of 2004 concerning waqf and law number 4 of 1996 concerning mortgages" is the criterion of banks in granting loans guaranteed by waqf land tied to Rights Deposits and efforts of the Bank in resolving bad loans guaranteed by waqf land tied to Mortgage. The research method the author uses the Normative Juridical literature method with the form of analytical descriptive research. In the results of the study it can be seen that the criteria of banks in granting loans guaranteed by waqf land are tied to Underwriting Rights using the principle of 5 C + 1 S. The Bank's efforts in resolving bad credit by Internal (Non Litigation or off-court) and External (through third parties / Lawyer) which includes summons, negotiations, mediations and collateral executions.
