- Corruption as an extraordinary crime (extraordinary crime) in handling requires determination and a strong effort from the government, including law enforcement officers. Until now corruption still tends to increase, even spread to the level of people's representatives. One example is corruption in Musi Banyuasin Regency conducted by members of the Musi Banyuasin Regency DPRD, Bambang Kariyanto (PDIP) Adam Munandar (GERINDRA) for the 2014-2019 period. The two people were declared to have committed a crime in the preparation and use of the APBD of Musi Banyuasin Regency. On that basis, the formulation of the problem was whether the Law Enforcement of corruption in the APBD was based on court decisions TIPIKOR number: 48 / Pid-Sus-TPK / 2015 / PN .Plg. in terms of fairness and return of regional money and what factors are the causes of corruption in the Regional Budget by the Musi Banyuasin District DPRD. This research is a type of qualitative research. The results showed that the public prosecutor at the corruption eradication commission demanded that the two defendants only use the minimum sentence in Article 12 letter a, namely 4 years imprisonment, while the judge of corruption in the IA class court in Palembang sentenced the defendants to differ from the demands public prosecutors namely Bambang Kariyanto 5 years 3 months and for Adam Munandar 4 years 3 months. Because before dropping the verdict, the panel of judges had considered the impact of the decision so that when convicted there were no other remedies taken by the legal counsel of the defendants and the public prosecutor. Thus the sentence imposed can be said to be in accordance with a sense of justice towards the accused, the community and the spirit and desire of the Indonesian people to eradicate corruption.
