KAJIAN HUKUM INTERNASIONAL TERKAIT DENGAN HOSTIS HUMANI GENERIS PADA KASUS ETNIS ROHINGYA DI MYANMAR

- Hostis Humani Generis is the enemy of humankind. The crimes that can be categorized as hostis humani generis inter alia genocide, crimes against humanity, and war crimes. One of the events where genocide, crimes against humanity and war crimes are allegedly committed is the violence toward Rohingya ethnic group in Myanmar. The problems of this research are the background of the conflict in Myanmar related to Rohingya ethnic group, the efforts of international community in responding the conflict that occurs in Myanmar, and whether the Rohingya ethnic group case can be categorized as hostis humani generis. The research aims to find out the background of the conflict in Myanmar related to Rohingya ethnic group, to find out the efforts of international community in responding the conflict that occurs in Myanmar, and to find out whether the Rohingya ethnic group case can be categorized as hostis humani generis. This research is a normative, by using statute approach, and also using secondary data obtained from the primary law, secondary law, and tertiary legal materials. The conclusions of this research are the backgrounds of the conflict in Myanmar related to Rohingya ethnic group are the discrimination and the violence that occur toward Rohingya ethnic group massively, the efforts of international community in responding the conflict that occurs in Myanmar are inter alia by doing diplomatic efforts and establishing the independent international fact-finding mission on Myanmar, and the Rohingya ethnic group case can be categorized as hostis humani generis because genocide, crimes against humanity, and war crimes are committed in Myanmar. The author suggests that the Rohingya ethnic group case should be referred to the International Criminal Court, do some efforts related to the repatriation of the victims, and establish a trust fund to support the victims.
