  • Mandatory will is an act of granting a will which is intended for heirs or relatives who do not get a share of the inheritance of the person who died, due to a shari'a obstacle. Mandatory wills according to KHI in Indonesia are given to adopted children and adoptive parents. The status or position given by KHI to legal adopted children (recognized) is based on a court decision while maintaining a blood relationship with legal parents, because of the principle of adopted children in KHI. The legal basis in Indonesia for Muslims is the distribution of inheritance for adopted children according to the KHI through grants or mandatory wills on condition that it does not exceed 1/3 (one third) of the inheritance of their adoptive parents, this is to protect other heirs.
