- ABSTRACTThis research aimed to find out the appeal-to-the Supreme Court filing by the defendantbased on judex factie ignoring the exclusionary rules in narcotic case examination.This study belonged to a normative law research concerning the appeal-to-the SupremeCourt filing by the defendant based on judex factie ignoring the exclusionary rules in narcoticcase examination employing primary and secondary law materials.The result of research showed that the appeal-to-the Supreme Court filing by thedefendant based on judex factie ignoring the exclusionary rules in narcotic case examinationhad been consistent with the provisions of KUHAP so that it was accepted by the Supreme Court.The judge of Supreme Court’s legal deliberation in hearing and sentencing the appeal-to-theSupreme Court filing by the defendant in narcotic case Number 417 K/Pid.Sus/2011 was that theJudge accepted the appeal by the defendant considering the fact the witnesses revealed in thetrial, and authenticating that within the defendant there was no unlawful deed, because therewas no evidence of fault element as the basis of unlawful deed for the defendant, so thatcondemnation could not be imposed to the defendant and for that reason, the defendant shouldbe liberated. ABSTRAKPenulisan Hukum ini bertujuan untuk mengetahui mengenai pengajuan kasasi olehterdakwa atas dasar yudex facti mengabaikan asas exclusionary rules dalam pemeriksaan perkaranarkotika.Penulisan hukum ini termasuk dalam jenis penelitian hukum normatif mengenaipengajuan kasasi oleh terdakwa atas dasar yudex facti mengabaikan asas exclusionary rulesdalam pemeriksaan perkara narkotika yang menggunakan bahan hukum primer dan bahanhukum sekunder.Hasil yang diperoleh dari penelitian ini yaitu bahwa pengajuan kasasi oleh Terdakwaatas dasar yudex facti mengabaikan asas exclusionary rules dalam pemeriksaan perkara narkotikasudah dengan ketentuan KUHAP sehingga pengajuan kasasi oleh terdakwa diterima olehMahkamah Agung. Pertimbangan hukum hakim Mahkamah Agung dalam memeriksa danmemutus pengajuan kasasi oleh terdakwa dalam perkara Narkotika Nomor 417 K/Pid.Sus/2011bahwa Hakim menerima pengajuan kasasi oleh terdakwa dengan mempertimbangkanberdasarkan fakta yang dikemukakan oleh para saksi di persidangan, serta membuktikan bahwapada diri Terdakwa tidak terdapat perbuatan melawan hukum, karena tidak terbukti adanya unsurkesalahan sebagai dasar perbuatan melawan hukum bagi Terdakwa, sehingga kepada Terdakwatidak dapat dikenakan sanksi pemidanaan dan oleh karena itu Terdakwa harus dibebaskan.
