- AbstrakPenelitian ini bertujuan untuk mengetahui proses persidangan terhadap terdakwa anak berdasarkan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak yang menerapkan pendekatan Keadilan Restoratif dengan melibatkan seluruh aspek masyarakat. Penelitian ini merupakan penelitian hukum normatif, karena menganalisa putusan pengadilan. Teknik pengumpulan data yang digunakan adalah teknik studi dukumen. Teknik analisis yang digunakan adalah silogisme. Berdasarkan hasil analisis dapat disimpulkan bahwa pada proses persidangan telah menerapkan pendekatan Keadilan Restoratif dengan melibatkan aspek aspek masyarakat. Serta dalam menjatuhkan putusan, Hakim telah menggunakan pertimbangan yuridis dan non-yuridis.Kata Kunci : Proses persidangan anak, Keadilan Restoratif, Pertimbangan HakimAbstractThe aim of this research are to know criminal proceeding of children defendant based on Law Number 11 of 2012 about Child Judicature System which applying Restorative Justice with involving the societies. This research is normative juridical by analyzing case law. The collected data were analyzed using document research technique. The analyzing technique were using syllogism. Based on analysis result there was concluded that the criminal proceeding already applying Restorative Justice with involved of societies. Also when brought to justice, the Judges already based on juridical and non-juridical consideration.Keywords: Child Judicature System, Restorative Justice, the Justice Considerations
