- ABSTRAK Penulisan ini mengkaji pertimbangan hakim dalam memutus terdakwa lepas dari segala tuntutan hukum dan upaya hukum yang dapat dilakukan kejaksaan Negeri Sleman terhadap putusan lepas dari segala tuntutan hukum dalam perkara kepemilikan senjata tajam. Penulisan ini menggunakan jenis penelitian normatif yang bersifat preskriptif dan terapan. Berdasarkan penelitian ini dapat diketahui tentang dasar pertimbangan hakim dalam menjatuhkan putusan lepas dari segala tuntutan hukum (ontslag van rechtsvervolging) adalah bahwa apabila yang didakwakan kepada terdakwa terbukti tetapi perbuatan tersebut bukan merupakan suatu tindak pidana. Pertimbangan hakim yang lain adalah apabila terdapat keadaan-keadaan istimewa yang menyebabkan terdakwa tidak dapat dihukum, yaitu adanya alasan pembenar dan alasan pemaaf. Dalam kasus ini hakim menjatuhkan putusan lepas dari segala tuntutan hukum karena perbuatan terdakwa tidak melawan hukum dan pertimbangan hakim telah sesuai dengan KUHAP. Kata kunci: Putusan, lepas dari segala tuntutan hukum, senjata tajam ABSTRACT This research examines the consideration of judges in deciding the defendant's escape from all lawsuits and legal actions that can be performed Sleman State prosecutor against the decision free from all charges in a case of possession of a sharp weapon. The research using this type of prescriptive normative research and applied. Based on this research can be seen on the basis of considerations of judges in decisions free from any lawsuits (ontslag van rechtsvervolging) is that if the defendant proved that the accused but the act does not constitute a criminal offense. Another consideration is the judge that if there are special circumstances which led the defendant can not be convicted, namely the existence of a justification and an excuse. In this case the judge ruled off of all charges because the defendant did not act against the law and judges consideration in accordance with the Criminal Procedure Code.
