- Tort is an agreement under the provisions of legislation that was born because of illegal human actions or not permitted by law. There are a lot of actions that will be considered as a tort, one of them is defamation. Defamation is the making of false statement concerning a person or business that damages that person’s or business’s reputation. Defamation can come from any where and any source and one of them is press. In Indonesia, Defamation by press can be seen as a violation to the law of tort and a vilolation to the press law. Defamation by press case can be settled by these two settlement mechanism, first by court using the tort law or two, by a mechanism given by the Indonesian press law which is an independent instance called the press council that one of its function is as an alternative way for press dispute settlement, and there’s some differences between those two dispute settlement mechanism. This thesis compares the compensation given by those two dispute settlement mechanism and compares the differences from those two dispute settlement mechanism. From the many prespectives the compensation given for the act of defamation by those two mechanism is the one that very different.
