  • Land have an important role in human’s life. Assurance of certainty of land is written on UUPA. As there is a must to register your ownership of land across Indonesia, then there is rules written on PP Number 24 Year 1997. But now, land certificate have not given certainty about legal ownership for a person’s object or land. In this study, taken one of the cases in Indonesia about double certificate of a land in Pontianak which is written in Verdict Number 373 K/TUN/2016 with Head of Pontianak Land Office as defendant against Drg. Eko Priyono S. as plaintiff. This verdict begins as there is a certified land of Drg. Eko Priyono S. with Certificate Number 1348/Parit Tokaya an area of 10.553 m2 located in Nur Hidayat Alley Rt.003/Rw.013 Parit Demang Dalam, City of Pontianak. But then appear another certificate with the Certificate Number of 17836/Kel Parit Tokaya an area of 2.425 m2 on behalf Nuraini. This study use normative approach which is reviewing positive law norms. In analyzing the fact of law this study use deductive method with two kind of approach which is laws approach and case approach. Factors that become the basis of this case are the Pontianak’s Land Office not working carefully in investigating and exploring the truth of fact about a land which is about to be certified. Legal protection provided by Panel of Judges to land certified owner in a verdict is already act correctly on applied laws. Suggestion in this study are: (1) Pontianak’s Land Office employee should be increasing their effort on the prevention of double certificate by doing registration of land systematically with more careful, accurate and thoroughly; (2) Pontianak’s Land Office should make a database of registration data each region or district about lands that already been registered or certified to someone.
