  • Indonesia needs to pave the way for the advancement of Industry as a mission to improve the country’s competitive power among other nations. Its competitiveness should be supported by the role of Industrial Design protection, which is part of the Intellectual Property Rights. The availability of legal protection regarding Industrial Design is needed to ensure protection of designers’ rights, while also to establish their obligations, as well as to keep other party from abusing their Industrial Design rights. The requirements of novelty standards in design creations are crucial and cannot be disregarded in the registration of design creations. There have been several cases in relation to Industrial Design that occurs. Frequently the problem concerns around the elements of commonality or similarity with respect to a particular design creation. Author in this case conducted a legal research with the intention to finding out the extent to which novelty requirements is concerned in the context of Industrial Design registration in Indonesia.
