  • The history of capital market in Indonesia started when Jakarta Stock Exchange was established in 1912. Capital market in Indonesia is regulated by the Law of the Republic of Indonesia No 8 Tahun 1995 concerning Capital Market. The Legal problems in the capital market are related to the violation of the laws concerning capital market, such as misleading information, fraud, market manipulation, insider trading, etc. Insider Trading is a kind of crime in capital market that concern insiders by giving them material information; this give benefits to one’s side and disadvantages to others. Insider trading will undermine the trust of the investors and it will inflict a financial loss. As stated in Law No 8 Tahun 1995 concerning Capital Market, one who classified as insiders are director, commissioner, employee, shareholder, and one who has close relation to discover material information. This thesis will analyze the application of misappropriation theory to categorize insider on Law No 8 Tahun 1995 concerning Capital Market.
