  • This research discussed about TRIPs, the derivative of the World Trade Organization (WTO) which is focused on Intellectual property rights (IPR) issues. Unlike other international organization, TRIPs have a Dispute Settlement Body (DSB) that regulated under the WTO dispute settlement rules. In this case, the example is about the dispute between The United States (U.S) and China related on the issues of copyright and trademark law. It is interesting to see how the DSB resolving the case and how the stages of dispute settlement in WTO, as not all international organization have. There are several International Relations theories that can be related on the case including, International Organization, International Treaties, International Law, Liberalism, International Political Economy, Decision Making Theory, and Peace Studies Theory. These theories will be linked to the evidences that has been collected then to analyzed and may provide an explanation of the case that taken. U.S. and China which are the two major countries and has an important role in commerce, having a high association with the intellectual property that contributes greatly to the national and international trade. IPR should get special attention because it relates to human development with the discoveries made by people who are creative. Given these findings, it can be an impact on human civilization, for example, with advances in communications dan technology which very helpful for human relation. Or writing the books of knowledge are used to promote public education. Therefore the existence of rules that protect these discoveries, the inventors also feel valued and have the desire to find other things that can provide benefits to the wider community. There are significant linkages between intellectual property rights and human development, then the IPR becomes an issue that is highlighted, it is important to be protected and the need for enforcement of intellectual property rights that run explicitly.
