- Studi ini bertujuan dalam rangka mengkaji pengaturan hukum tindak pidana pembunuhan terhadap anak baru lahir oleh ibu kandung berdasarkan hukum positif Indonesia. Metode yang dituangkan dalam penelitian ini adalah metode normative melalui cara deskriptif pendekatan konseptual serta peraturan perundang-undangan. Hasil dari studi ini adalah pengaturan hukum tindak pidana pembunuhan terhadap anak yang baru lahir oleh ibu kandung terdapat dalam Pasal 342 dan 341 KUHP, serta bentuk pertanggungjawabannya dapat dilakukan selama perbuatan tersebut memenuhi unsur-unsur dari Pasal 342 dan 341 KUHP. This study aims to examine the legal arrangements for the crime of killing a newborn child by a biological mother based on Indonesian positive law. The method outlined in this study is a normative method through a descriptive conceptual approach and laws and regulations. The results of this study are that the legal arrangements for the crime of killing a newborn child by a biological mother are contained in Articles 342 and 341 of the Criminal Code, and the form of accountability can be carried out as long as the act fulfills the elements of Articles 342 and 341 of the Criminal Code.
