- AbstrakHasil dari penelitian ini menunjukkan bahwa kepastian hukum jual beli tanah adat dengan pelepasan adat di kota jayapura dalam proses perkembangannya semakin membaik, dengan regulasi yang dikeluarkan oleh Pemda Papua, pada dasarnya seseorang yang sudah memiliki surat pelepasan adat mereka memiliki perlindungan hukum yang lebih terjamin daripada orang yang tidak memiliki bukti surat pelepasan adat, dan surat pelepasan adat merupakan bukti terkuat dalam jual beli tanah adat dengan pelepasan adat di Kota Jayapura.Kata Kunci :jual beli tanah adat, pelepasan adat, surat bukti pelepasan adat, perlindungan hukum, ondoafi, masyarakat adat.AbstractThe results of this study indicate that legal certainty sale and purchase of customary land with the release of customs in the city of Jayapura in its development process is getting better, with the regulations issued by the Government of Papua, basically someone who already has a release of their customary legal protection is more secure than those who do not have evidence of customary release letter, and the letter of the customary release of the strongest evidence in customary land purchase with the customary release in Jayapura.Keywords: Buy Sell Indigenous Lands, Indigenous release, Proof of Indigenous release, Legal Protection, Ondoafi, Indigenous Peoples.
