- The purpose of this study was to determine how the procedure to obtain a birth certificate children outside marriage and juridical effects after the Constitutional Court's Decision No. 46 / PUU-VIII / 2010. This research method is research by reviewing various legal materials related to the research object. Results of research and discussion is the procedure to obtain a birth certificate after the Constitutional Court 46 / PUU-VIII / 2010 of the first through the Decision / Determination of the District Court, and the juridical impact seen in the Child Protection Act, the inclusion of the name of the biological father, and inheritance as well as the influence of alimony father against children outside marriage. Conclusion The preparation of this paper is the Decision of the Court 46 / PUU-VIII / 2010 procedures for obtaining birth certificates children outside marriage in advance by the District Court to obtain Decision / Determination of the biological father and the related effects, alimony. The suggestion is that there should be cooperation between all parties to protect the interests of children outside marriage.
