- One of the new substance in Law Number 12 of 2011 regarding Regulation’s Formation is the placement of People’s Consultative Assembly decision in the regulations hierarchy, which is under the Indonesian constitution of 1945 and above the law. Such placement is appropriate considering that there are few valid and binding People’s Consultative Assembly decisions according to People’s Consultative Assembly Decision Number I/MPR/2003. The People’s Consultative Assembly decision is also a fundamental rule of a state or a basic rule of a state (staatsgrundgesetz) as well as the body of Indonesian constitution of 1945 considering that the People’s Consultative Assembly decision is the foundation of law’s formation (formell gezetz) and other lower regulations before the amendment of the Indonesian constitution of 1945.ABSTRAKSalah satu substansi baru dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan adalah penempatan Ketetapan Majelis Permusyawaratan Rakyat dalam hierarki peraturan perundang-undangan. Ketetapan MPR ditempatkan dibawah Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan diatas undang-undang. Penempatan Ketetapan MPR dalam hierarki peraturan perundang-undangan adalah tepat mengingat masih terdapat Ketetapan MPR yang masih berlaku dan mempunyai kekuatan mengikat berdasarkan Ketetapan MPR Nomor I/MPR/2003. Ketetapan MPR juga merupakan aturan dasar negara atau aturan pokok negara (staatsgrundgesetz) sebagaimana halnya dengan Batang Tubuh Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dikarenakan Ketetapan MPR menjadi landasan pembentukan undang-undang (formell gezetz) dan peraturan lain yang lebih rendah sebelum perubahan UUD Tahun 1945.
