  • ABSTRACT In the event that involves the seller and the buyer of the land, there is agreement by which one party binds himself to deliver a material, and the other party to pay the price that was promised. To date there is still a phenomenon in which the sale and purchase of land is done by the village head. Based on these issues, the issues to be studied are how the rule of law in the sale and purchase of land in front of the village chief, and how the forms of legal protection for good faith purchaser in the sale and purchase of land by the village head. The method used is the method of normative research. The role of the village chief in the sale and purchase of land in practice is as a witness, noting the shift of land rights by way of selling the land in the village, creating a certificate of inheritance and collect fees on every transaction of sale and purchase of land. Deed as a proof of contents and signatures contained therein are recognized by both parties. Based on this, the deed that has earned legalization of village heads in terms of evidence, due to the recognition of the signature, then the contents of deed was regarded as agreements between the parties for deed the truth lies in the hands of the parties, with the recognition of the signature, the act is perfect evidence. To ensure legal certainty and protection for holders of rights to the land, it would be good if the government carries out land registration is accompanied by the provision of proof of rights to land parcels which occur as a means of strong evidence.
