- ABSTRAK Fenomena/gejala Korupsi, Kolusi dan Nepotisme (KKN) di Indonesia telah merambah di berbagai kalangan, baik penyelenggara negara yang meliputi eksekutif, legislatif dan yudikatif maupun masyarakat pada umumnya. Gejala yang sangat menarik di Indonesia adalah setiap kali ganti rezim/pemimpin, slogan atau issue pemberantasan dan pembasmian KKN senantiasa dijadikan komitmen pokok bagi penguasa yang baru tersebut. Tetapi prakteknya sangat jauh dari harapan atau harapan sangat jauh dari kenyataan. Oleh karena itu korupsi harus dihadapi dengan suatu strategi tertentu dengan pendekatan yang sifatnya holistik, integral dan melibatkan semua komponen bangsa. Sejalan dengan pemikiran tersebut, maka strategi pemberantasan korupsi tidak hanya menggunakan pendekatan hukum (hukum pidana/pendekatan penal), tetapi juga dengan pendekatan non penal. Kata Kunci : Kebijakan, Hukum Pidana, Korupsi. ABSTRACT Phenomena/ symptoms of corruption, collusion and nepotism (KKN) in Indonesia has served in various groups, both state officials which as executive, legislative and judicial branches of government and society in general. Symptoms are very interesting in Indonesia is that every time the dressing regime / leaders, slogan or issue eradication and eradication of corruption continue to be a fundamental commitment for the new rulers. But the practice is far from expectations or hopes are very far from reality. Therefore, corruption must be faced with a particular strategy with the holistic approach, integral and involve all componrnts of the nations. In line with this thinking, the strategy to eradicate corruption not only use legal approach (criminal / penal approach), but also with non penal approach. Keywords: Policy, Criminal Law, Corruption.
