This minor thesis was conducted due to the violation of legal norms by entrepreneurs. Entrepreneurs infringed Code of Law Article 1367 Verse (3) that provides a regulation concerning entrepreneurs’ responsibility to compensate any detriment of other parties caused by infringement of law committed by the workers when they are working. This regulation is violated by the establishment of working agreement. Based on these explanations, a legal issue can be drawn regarding to whether or not the transfer of entrepreneurs’ responsibility relative to infringement of law committed by workers regulated in working agreement can make the agreement withdrawn on the behalf of law. The research method used was normative juridical method with legislative and case approach. Based on Law Number 13 Article 52 Verse (1) of 2003, approved requirements of working agreement have been established. However, some entrepreneurs do not mind that regulation by establishing a clause that violates the ruling law. Although the working agreement is approved, the clause that goes against the law cannot be maintained. The results of this study show that the clause of transfer of responsibility adjusted in working agreement does not possess obligatory power since it goes against Code of Law Article 1367 Verse (3) that has provides a provision related to that issue.
