- This article focused on the protection of child’s rights in Sociological of Law Perspective. Since the Act Number 3, 1977 about Child’s Court takes into forced, causes some obstacles between the purpose to be achieved in criminal justice system and the protection of child’s rights in Indonesia. In this article, first of all, we look into the background of why it is really needed to protect the children who involved in criminal cases. Moreover, we search the criminal justice system in Indonesia. Furthermore, we continue to bicuspids about the protection of child’s rights in the stage of investigation (pra-adjudication). The main focus of this article is the discussion on the protection of children from sociological of law perspective. Finally, we will examine what is the best criminal justice system for the children in the future.
