- Asas Kepercayaan adalah asas yang mengandung makna bahwa setiap orang yang akan mengadakan perjanjian akan memenuhi setiap prestasi yang diadakan diantara mereka.Permasalahan dalam penelitian ini adalah implementasi asas kepercayaan dalam jual beli online pada marketplace Shopee, dan upaya hukum yang dilakukan jika salah satu pihak melakukan wanprestasi dalam jual beli online pada marketplace Shopee. Metode penelitian dalam penelitian ini adalah hukumnormatif dengan tipe penelitian deskriptif dan pendekatan masalah secara yuridis normatif. Data yang digunakan adalah data sekunder terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Metode pengumpulan data yang dilakukan adalah studi pustaka. Semua data dikumpulkan dianalisa secara kualitatif. Hasil penelitian dan pembahasan menunjukan bahwa Asas Kepercayaan dalam Jual Beli Online Melalui Marketplace Shopee belum terimplementasi. Tidak menutup kemungkinan banyak terdapatnyapelanggan yang merasa dirugikan atas ketidaksesuaian barang yang diterima. Upaya hukum yang dapat dilakukan jika salah satu pihak melakukan wanprestasi. non litigasi, pihak yang merasa dirugikan bisa menuntut pemenuhan perjanjian, pembatalan perjanjian atau meminta ganti kerugian pada pihak yang melakukan wanprestasi melaluifitur komplain. Litigasi, Jika dalam diskusi komplain tidak mendapatkan titik temu, pihak yang merasa dirugikan dapat mengajukan gugatan di pengadilan sesuai Pasal 38 UU ITE, para pihak dapat menggugat apabila dalam penyelenggaraan transaksi elektronik merugikan pihak lain, dan Pasal 1266 KUH Perdata, wanprestasi dari satu pihak memberikan hak kepada pihak lainnya untuk memutuskan kontrak di pengadilan. Kata Kunci: Asas Kepercayaan, Jual Beli Online, Marketplace Shopee The Principle of Trust is a principle which implies that everyone who will have an agreement will fulfill every achievement held between them. The problem in this research is the implementation of the principle of trust in online purchases in the marketplace Shopee and legal solutions do if one of the parties in default in buying and selling online in the marketplace Shopee. The method used in this study is the kind of normative research with descriptive type and approach normative juridical problems. The data used are secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Data collection methods used literature studies. All the collected data were analyzed qualitatively.. The results of research and discussion show that the Principle of Trust in Buying and Selling Online Through Market Place Shopee has not been implemented. It does not rule out that there are customers who feel aggrieved for the discrepancy of the goods received.. Legal remedies that can be carried out if one of the parties violates, non-litigation, the party who feels aggrieved can demand fulfillment of the agreement, cancel the agreement or request compensation from the party conducting the default through the complaint feature. Litigation, if the complaint discussion did not get the meeting point, the parties may be harmed may file a lawsuit in court in accordance with article 38 of Law ITE, the parties may sue the agreement in the implementation of electronic transactions with other parties,and article 1266 of the Civil Code, the non-performance contract of one party gives the other party to terminate the contract in court.
