GO-JEK Indonesia Cabang Kota Bandar Lampung Dan Dinas Tenaga Kerja Kota Bandar Lampung) Oleh ANISANDRA EKAYANTI Di era perkembangan teknologi ini terdapat inovasi-inovasi baru salah satunya adalah munculnya suatu transportasi online yang berbasis aplikasi dan internet yaitu GO-JEK yang memiliki pengaruh cukup besar yaitu membantu masyarakat untuk melakukan aktivitas dan memenuhi kebutuhannya sehari-hari agar menjadi lebih mudah. Pemerintah belum sepenuhnya memberikan perlindungan hukum bagi pekerja PT. GO-JEK sesuai dengan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan terutama perlindungan terhadap driver. Permasalahan dalam penelitian ini adalah: (1)Bagaimana perlindungan hukum terhadap pekerja dan driver PT. GO-JEK Indonesia di kota Bandar Lampung? (2) bagaimana faktor pendukung dan penghambat dalam perlindungan hukum terhadap para pekerja dan driver GO-JEK di kota Bandar Lampung? Metode penelitian yang digunakan dalam permasalahan ini adalah pendekatan yuridis normatif dan yuridis empiris. Jenis data menggunakan data sekunder dan data primer. Analisis data menggunakan analisis kualitatif. Hasil penelitian dan pembahasan ini menunjukkan:(1) perlindungan hukum terhadap pekerja PT. GO-JEK Indonesia di kota Bandar Lampung meliputi Hak Jamsostek, Hak Keselamatan dan Kesehatan, Hak Upah, Hak Cuti dan lain-lain dan perlindungan terhadap driver hanya berupa pasar polis yang diberikan oleh PT. GO-JEK Indonesia. (2) Faktor pendukung dalam pelaksanaan perlindungan hukum pekerja dan driver di PT. GO-JEK Indonesia adalah penerapan pemerintah dalam perlindungan hukum tersebut terdapat dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan yang menjadi dasar dari terlaksananya perlindungan hukum tersebut. Faktor penghambatnya adalah bahwa beberapa dari pekerja di PT. GO-JEK belum sepenuhnya memahami apa saja yang seharusnya menjadi hak mereka, serta belum ada aturan khusus yang diberikan atas dasar perlindungan untuk kesejahteraan para driver sehingga pemerintah maupun perusahaan tidak memberikan apa yang menjadi hak seorang driver secara optimal dan menyeluruh karena statusnya adalah seorang mitra. Kata Kunci: Perlindungan hukum, hak-hak pekerja, mitra, pengemudi GOJEK. ABSTRACT LEGAL PROTECTION TO THE WORKER’S AND DRIVER’S OF PT. GO-JEK INDONESIA IN BANDAR LAMPUNG CITY (Study On PT. GO-JEK Indonesia Branch Of Bandar Lampung City And Labor Office Of Bandar Lampung City) By ANISANDRA EKAYANTI In this era of technological development there are new innovations, one of them is the emergence of an online transportation which based on application and internet, namely GO-JEK. In the mids of society, GO-JEK has a significant influence in helping the community to do their activities and meet their daily needs to become easier. The government has not fully provided legal protection for PT. GO-JEK drivers in accordance with Law No. 13 of 2003 concerning Manpower especially protection againts the drivers. The problems of this research are: (1) how is legal protection to the worker’s and driver’s of PT. GO-JEK Indonesia in Bandar Lampung city? (2) how are the inhibiting and supporting factors in legal protection to the worker’s rights and the drivers in Bandar Lampung city? The research method used in these problems are the normative and empirical juridical approaches.The type of data uses secondary data and primary data.Data analysis using qualitative analysis. The result of these research and discussion show: (1) legal protection to theworkers’ and drivers’ of PT. GO-JEK Indonesia in the city of Bandar Lampung is included the Social Assurance of The Workforce Rights, Safety and Health Rights, Wages Rights, Leave Rights and others, and protection of drivers only in the form of anpolicy market provided by PT. GO-JEK Indonesia. (2) Supporting factors in implementing legal protection for workers and drivers at PT. GO-JEK Indonesia is the application of government in the protection of the law contained in Law No. 13 of 2003 concerning Manpower that become the basis of the implementation of the legal protection. The inhibiting factors are that some of the workers at PT. GO-JEK do not fully understand what is rightfully theirs, and there are no specific rules given on the basis of protection for the welfare of the drivers so that the government and the company do not give the rights of a driver optimally and comprehensively because their status are partners.
