- Perlindungan penyandang disabilitas termaktub dalam Convention on the Rights of Person with disabilities (CRPD) yang diratifikasi dengan pengesahan UU Nomor. 19 Tentang Pengesahan Convention on the Rights of Person with disabilities. Namun, perlindungan hak penyandang disabilitas masih termarginalkan. Begitu juga hak mereka untuk mendapatkan perlakuan khusus pada sarana dan prasarana transportasi udara. Penelitian ini menggunakan metode yuridis normatif untuk mengkaji perlindungan penyandang disabilitas dalam Convention on the Rights of Person with disabilities (CPRD) dan bagaimana implementasi perlindungan penyandang disabilitas dalam bidang transportasi udara pada peraturan perundang-undangan di Indonesia. Hasil penelitian menunjukkan Convention on the Rights of Person with disabilities (CPRD) mengatur mengenai aksesibilitas, mobilitas, kesehatan, pekerjaan, dan pertisipasi politik berdasarkan prinsip persamaan dan non-diskriminasi dalam melindungi penyandang disabilitas. Namun, tidak mengatur secara khusus mengenai perlindungan penyandang disabilitas dalam bidang transportasi udara. Sedangkan pengaturan mengenai perlindungan penyandang disabilitas dalam bidang transportasi udara di Indonesia diatur dalam undang-undang, peraturan pemerintah, dan peraturan menteri. Kata kunci: penyandang disabilitas, perlindungan hak penyandang disabilitas, transportasi udara. PERLINDUNGAN PENYANDANG DISABILITAS DALAM CONVENTION ON THE RIGHTS OF PERSONS WITH DISABILITIES AND OPTIONAL PROTOCOL DAN IMPLEMENTASINYA DI INDONESIA DALAM BIDANG TRANSPORTASI UDARA ABSTRACT Protection about person with disability is contained in the Convention on the Rights of Persons with Disabilities (CRPD) which is ratified by UU No. 19 Tentang Pengesahan Convention on the Rights of Person with disabilities. However, the protection of the rights of persons with disabilities is still marginalized. Likewise their rights to get special treatment for air transportation facilities and infrastructure. This research uses a normative juridical method to study the protection of persons with disabilities in the Convention on the Rights of Persons with Disabilities (CRPD) and how to implement the protection of persons with disabilities in the air transportation area in the legislation in Indonesia. The results of the research shown that the Convention on the Rights of Persons with Disabilities (CRPD) regulates to accessibility, mobility, health, employment, and political participation based on the principle of equality and nondiscrimination in protecting persons with disabilities. However, it does not specifically regulate to the protection of persons with disabilities in the air transportation area. While the regulation regarding the protection of persons with disabilities in the field of air transportation in Indonesia is regulated in laws, government regulations and ministerial regulations.
