- Pasang surut dan konfigurasi politik yang terjadi di Indonesia sejak era Orde Lama, Orde Baru, hingga Reformasi juga mempungaruhi sistem Kekuasaan Kehakiman di Indonesia hingga berdampak pula pada rekrutmen hakim pengadilan tingkat pertama. Penelitian ini bertujuan mengetahui rekrutmen hakim pengadilan tingkat pertama sejak era Orde Lama hingga terbitnya Putusan Mahkamah Konstitusi Nomor 43/PUU-XIII/2015. Jenis penelitian ini adalah penelitian yuridis normatif dengan cara melakukan pengkajian literatur dan sumber hukum yang berkaitan dengan permasalahan yang diangkat dengan pendekatan historical approach dan comparative approach. Hasil penelitian ini menunjukkan bahwa pada era Orde Lama dengan Demokrasi Terpimpin, hakim adalah sebagai alat revolusi. Rekrutmen Hakim Pengadilan Tingkat Pertama pada saat itu menjadi wewenang Mahkamah Agung dan Kementrian Kehakiman.Pada era Orde Baru di mana mekanisme pola rekrutmen hakim pengadilan tingkat pertama masih menggunakan pola rekrutmen Pegawai Negeri Sipil. Sehingga kedudukannya sebagai hakim mengalami dualisme kelembagaan, apabila dilihat aspek administratif, organisatoris, serta finansial berada pada kewenangan eksekutif karena sebagai Pegawai Negeri Sipil. Pasca putusan Mahkamah Konstitusi Nomor 43/PUU XIII/2015 rekrutmen Hakim Pengadilan Tingkat Pertama yang dilakukan sendiri oleh Mahkamah Agung pada tahun 2017 masih dengan pola rekrutmen yang sama dengan sebelumnya yaitu Pegawai Negeri Sipil. Kedepan rekrutmen hakim Pengadilan Tingkat Pertama yang dilakukan oleh Mahkamah Agung harus menggunakan pola rekrutmen dengan mekanisme seleksi hakim sebagai Pejabat Negara sehingga terciptanya negarawan yang mengedepankan independensi hakim dalam mencari keadilan tanpa intervensi pihak manapun. Kata Kunci: Rekrutmen, Hakim Pengadilan Tingkat Pertama RECRUITMENT OF THE FIRST COURT OF JUSTICE COURT (Study of Constitutional Court Decision Number 43/PUU-XIII/2015) The ups and downs and political configurations that have taken place in Indonesia since the Old Order, the New Order, and the Reformation era also influenced the system of Judicial Power in Indonesia, which also affected the recruitment of first-level court judges. This study aims to find out the recruitment of first level court judges since the Old Order era until the issuance of the Constitutional Court Decision Number 43/PUU-XIII/2015. This type of research is normative juridical research by reviewing literature and legal sources related to issues raised by the historical approach and comparative approaches. The results of this study indicate that in the era of the Old Order with Guided Democracy, judges were as tools of revolution. Recruitment of first level court judges at the time was under the authority of the Supreme Court and Ministry of Justice. In the New Order era where the mechanism of recruitment patterns of first level court judges was still using the recruitment pattern of Civil Servants. So that his position as a judge experienced institutional dualism, if viewed from the administrative, organizational, and financial aspects, he was in executive authority because he was a civil servant.After the Constitutional Court Decision Number 43/PUUXIII/2015 the recruitment of First Level Court Judges conducted by the Supreme Court alone in 2017 is still with the same recruitment pattern as before, namely the Civil Servants. In the future the recruitment of First Level Court judges conducted by the Supreme Court must use recruitment patterns with the selection mechanism of judges as State Officials so that the creation of statesmen who prioritize the independence of judges in seeking justice without the intervention of any party.
