  • Franchise Agreement is an agreement between franchisor and franchisee, in which franchisor give franchisee the rights to the franchise to produce or market goods and or services in a particular time and place agreed upon under the supervision of our franchise, while franchisee of a number of franchises to pay money particular the obtaining of the right. This study would examine in depth issues related to the implementation of the franchise agreement between the management Resto Gama with franchisee. The formulation of the problem as follows: 1.) How implementation of the franchise agreement between the management Resto Gama as franchisor and franchisee, 2.) What are the forms wanprestasi form in the implementation of the franchise agreement between the management Resto Gama as franchisor and franchisee, 3. ) How the settlement made on the form of wanprestasi. In this research, the author uses sociological methods juridical. Of data through interviews and documentation, while the analysis of the data used was a qualitative descriptive analysis. Results of this study show that implementation of the franchise agreement between the management Resto Gama and franchisee have been enough to provide legal protection for the parties. Wanprestasi settlement in the case is completed and discussion with the family, through the media where the negotiations with the way it happened will agreement between the two, as mentioned in the contents of the agreement and does not occur when the terms both parties will be completed through the Court of Malang. This study recommends the need for improvement franchise agreement clause so clear legal relationship between the parties and the negotiations should be poured in the form of writing.
