- The train transportation tool in Indonesia has become the most transportation tool that used by passengers to travel to their own destination. The passengers choose to travel by train because of the tariff is cheap and they don’t have to spend long time during the travel. And when-for some reason-the accident’s happened, the train’s transport will have to be responsible. The object of this research is the responsibility of PT Kereta Api Indonesia according to the accident’s risk on passengers, based on the equality in transportation. The purpose of this research is to know how is the realization of PT Kereta Api Indonesia of the accident’s risk on passengers based on equality in transportation. The method used in this research is Juridical and sociological method. All data in this research collected by interviewing, documentation and also from literatures. The responsibility to the passengers in train’s accident were not handled straight just by PT KAI, but PT KAI give in abundance the responsibility to PT Jasa Raharja. PT KAI were only gave the expenses to the passenger treatment (if accident were happened) every month. For some case, because of the limited cost, PT KAI didn’t fund the passenger’s treatment until they get well. So, the passengers have to depend their own money to occur themselves. PT KAI didn’t know how does PT Jasa Raharja do the responsibility.
