- This research is about struggle of wife who had been divorced by her husband in getting her rights, especially her waitingtime subsistence (Living, Clothing, Subsistence), mut’ah dan madhiyah in Malang City Islamic Court, it was conducted due to relate toward Laws Rule and Islamic Law, a spouse has tight with rights and duties in waitingtime such as a husband has duty to give subsistence to his wife, provide homestay, clothing or kiswah and give mut’ah. However, many spouses separated their homestay directly in our society when they divorced; this made them slighted the rights and duties, whereas Married Law stated that inattention of the duty by only one side giving rights to another to claim in Islamic Law. Therefore, this research is important to be conducted to observe the struggle which had done by a wife who was repudiation divorced by her husband in getting her rights and to know how Malang City Islamic Court in accepting, inspecting, arbitrating, and deciding the wife’s rights. Based on the result of this research, the writer found the data that the wife’s struggle in getting her special right from repudiation divorce is put a motion of reconvention claim written andorally in checking the case when repudiation demand happen and it hasn’t been decide yet. Then, the excuse did by the applicant a moment after the repudiation profess was given by a husband to his wife.
