- Basically, law acts in Indonesia, cover some basic people rights, such as Indonesian Constitution of 1945, Criminal Law Book (KUHP), Indonesian Laws No. 39 1999 of Judicial Affairs Power, Indonesian Laws No. 39 1999 of Civil Rights. These rights are right of acknowledgement, security, protection, and fair law assurance as well as equal treatment before the law. Further, it is stated that every person (especially the suspect or the defendant) who is suspected, caught, charged, and filed a suit in a court must be considered innocent before the decision is being made by the courtin that having fixed legal power. Thus anyone, including police and press, must respect the presumption of innocence by not doing discriminative actions and underestimate to the rights of the suspect. Problem formulation in this final assignment is to know the legal and non legal effect resulted by the criminal news broadcasting on television toward the suspect who has not been proved to be guilty, and to acknowledge the legal responsible of criminal news on Batu TV station. The method used in the study is sociological juridicial, a discussion that is based on the regulation and related with reality. The data used is primary data through interview and documentation, and the secondary data is collected from library. This research aims to recognize the legal and non legal effect resulted by the criminal news broadcasting on television toward the suspect who has not been proved to be guilty, and to acknowledge the legal responsible of criminal news on Batu TV station. The result indicates that many criminal programs, such as criminal news on television, basically quite fair to be presented or broadcasted as a from of people freedom of accessing information from mass media. However, based on previous explanation, it violates the presumption of innocence, mainly the criminal news. It may be observed from the common of right violation presentation of a suspect, which is accompanied by the police violence toward the criminal suspect. It is wrong, since the suspect still have right starting from the process of preliminary axamination (investigation) to trial which makes a decision. The police, journalist and society must not treat them improperly. Therefore, being realized or not, TV stations that frequently intend to increase its program rating, through their criminal news give negative effect to some parties, for instance the victim or the news (the suspect), children, people, and they who may imitate that criminal action.
