- The Cases of criminal libel made Luna Maya with the Internet media, especially social networking, indicates that the lack of a comprehensive and profound understanding about the independence and freedom of expression and the concept of the Internet itself. The contradiction between the principle of freedom of expression with limits penencemaran good name through the internet which is a phrase as stipulated in Article 27 paragraph (3) Jo UU ITE. 310 paragraph (1) and (2) of the Criminal Code. Writing this took the formulation of the problem: 1.Apakah phrase "infotainment rank more despicable than the prostitution, murder, may ur soul burn in hell about 13 hours ago" written LunaMaya twitternya account has fulfilled the reason for entangled with Article 27 paragraph (3) UU-ITE and Article 310 paragraph (1) and (2) of the Criminal Code? Luna Maya aquo 2.Jika expression can be categorized as criminal defamation, the law subjects which are entitled to make a complaint to the police? This writing method, a normative juridical approach, data collection techniques in the form of literature by examining the scientific books of law and legislation of Article 27 UU ITE and Article 310 of the Penal Code and relevant laws. The results were analyzed comparatively. Complaints to the local police conducted by Priyo Wibowo infotaiment as representatives of the parties relating to criminal libel made by Luna Maya, which indicated compliance subjective and objective elements of Article 27 paragraph (3) UU-ITE about defamation. Whereas according to Article 310 of the Criminal Code act Luna Maya were not proven due to not meet the elements of article teersebut. In conclusion, the implementation of UU-ITE as a basis for substantive legal basis in the legal settlement of defamation cases by Luna Maya can be done, this depends on the choice of law a victim of crime is libel.
