- This Thesis mainly discusses the legal standing of a Personal Guarantor in the Suspension process of Debts Payments (PKPU) in Indonesia. Until today, there are sill no specific regulations governing the legal standing of Personal Guarantor in the stated event, especially Guarantor who has forfeited its privileges as the Insurer. This caused a legal uncertainty which can be reflected in variance and different opinion also dissimilarity of Judges interpretation and legal experts regarding the legal standing of the Personal Guarantor in PKPU. However, the current stipulations and regulations, allows the Guarantor to be filed under the PKPU. As the Case Study, research that has been done in the making of this thesis is a case regarding PKPU petition towards Richard Setiawan in his legal standing as a Guarantor.;This Thesis mainly discusses the legal standing of a Personal Guarantor in the Suspension process of Debts Payments (PKPU) in Indonesia.
