- Marriage was an inner bond between a man and woman as husband and wife with the aim to forming a happy and everlasting family (household) based on the Godhead. But in a couple's household, there will certainly be a problem, which causes the problem of a less harmonious household that starts from a small conflict until the problem becomes large and it impacts on a divorce. The people of Mulyoagung Village understand this by finding solutions to do bangun nikah practice or in Arabic called tajdidun nikaḥ which aims to repair or restore a better and happier household. The purpose of this research was to find out in-depth related to the practice of tajdidun nikaḥ, in which it examines how the practice was and how if the practice was reviewed based on the Compilation of Islamic Law (KHI). This research was conducted in Dermo Hamlet, Mulyoagung Village, Dau District, Malang Regency. The research type that used in the research framework was refer to the qualitative Sociological Yuridical approach. The results of this research were: The reason behind the subject to doing tajdidun nikaḥ was to repair the household to be better and more affectionate because it has experienced family problems until there was a separation between husband and wife for a long enough period that was one and a half years. In practice, as was the case with general marriages, there was no new marriage book because the couple was legally married and registered at the Office of Religious Affairs (KUA) Dau sub-district. When reviewed based on the Compilation of Islamic Law (KHI) the practice does not cause permanent legal conflict, jumhur ulama 'understands that it was permissible, because repeating the first marriage contract in the second contract and does not damage the first marriage contract with the bridegroom's record still believe that the first marriage was not broken.
