- The purpose of this research is to find out how the protection of consumers who use escrow services in conducting online trading transactions is seen from positive laws through consumer protection laws, information laws and electronic transactions, government regulations regarding the implementation of electronic transaction systems and laws trading. Whereas through Islamic law through Muamalah, Samsarah, Al-Ba'i, the Association of Islam and Khiyar. This study uses normative legal research, and uses primary legal material sources in the form of the Qur'an, Hadith, Jurisprudence, the results of Ijtihad scholars, Law Number 08 of 1999 concerning Consumer Protection, Law Number 11 of 2008 concerning Information and Electronic Transactions, Government Regulation Number 82 of 2012 concerning Operation of Electronic Systems and Transactions, Law Number 7 of 2014 concerning Trade. Secondary legal materials such as legal experts' opinions, theories, works from legal circles, internet searches, scientific articles, journals, and papers. Whereas tertiary legal material in the form of dictionaries, encyclopedias. The results of this study indicate that Legal Protection Against Consumers in Online Buying and Selling Practices with Escrow Services According to Positive Law and Islamic Law has been very well done by online shops providing escrow services, this is based on the contents of the terms and conditions of the online store in accordance with the articles Article contained in Law Number 08 of 1999 concerning Consumer Protection, Law Number 11 of 2008 concerning Information and Electronic Transactions, Government Regulation Number 82 of 2012 concerning Operation of Electronic Systems and Transactions, Law Number 7 of 2014 concerning Trade . But of the 6 consumer protection goals there is 1 point that is not met because online service providers make a standard contract to release the responsibility of compensating users. Likewise in Islamic law, the standard contract regarding the release of responsibility is not in accordance with the principle of justice in muamalah.
