  • Land and Customary Law Society have a very close relationship, the legal relationship created between land and the Customary Law Community a right to the Customary Law Community as a community group. The rights created because of this legal relationship are absolute. The rights that follow them grow and develop along with the times faced by the Customary Law Society, which one of them is Communal Rights. It is hoped that the granting of Communal Rights to the Community of Customary Law can be a stepping stone by the government in protecting the rights of the Indigenous Law Community which are spread throughout the territory of Indonesia this study aims to find out and understand how the process of implementing Communal Rights in Tamilouw Village. And how procedural the granting of Communal Rights to Villages that have never registered their Communal Rights. In addition, this study also aims to know widely about the regulation of the Customary Law Society and the rights they have. The method used in this writing is Empirical Sociology, using the Sociological Juridical approach, which is a starting point on primary data obtained directly from the community as the first source through field research. The conclusions in this study confirm that if Tamilouw Village as a research location can be granted Communal Rights because it meets the criteria mentioned by Ministerial Regulation No. 10 of 2016.
