- This study aims to determine the crime of rape which has the role of the victim or participation in the Batu City police station, the high rate of rape crime which almost always has news in the mass media, which according to the rape community are a despicable act and a form of crime decency. The crime of rape is regulated in Article 285 of the Criminal Code (Book of Criminal Law). The Rape Criminal Case research has the role of the victim or participation, the victim who did nothing but his attitude encouraged to become a victim. Form the role of victims such as people who wear mini clothes, tight, watch pornographic films and influence alcoholic beverages. The research method that the writer uses is sociological juridical, by collecting primary data making observations and field studies directly to the respondents as well as from books, scientific works, articles. The results of this study indicate that in 2017 in Batu City Police there were three cases in Rape Crime, there was the role of victims, in which three cases included victims having limited speech, together in quiet homes, watching porn and victims' lack of caution. For society, the researcher suggested that being more careful and cautious in their attitude.
