  • One form of extraordinary crime (extraordinary crime) is corruption that is happening in Indonesia today, has been in a very severe position and is so entrenched in every joint of life. The formulation of the problem in this research is 1) How is the implementation of remission for prisoners of corruption in Malang II Class LAPAS? and 2) What factors are taken into consideration in the provision of remissions for prisoners of corruption in Malang City Class IIA LAPAS ?. In this study, the approach used by the author is empirical juridical and this study uses both primary and secondary data. To produce and obtain accurate and objective data in accordance with what is the purpose of this study, the analysis of the data used in this study is a qualitative descriptive data analysis technique. Haspat is known that the implementation of Remission in the Penitentiary System as Fulfillment of Prisoners' Rights at the Class II A Malang Women's Penitentiary Institution has been implemented based on Law Number 12 of 1995 concerning Correctional Services, Government Regulation Number 28 of 2006 concerning Amendment to Government Regulation Number 32 of 1999 Regarding the Terms and Procedures for Implementing Penal Prisoners' Rights, Government Regulation Number 28 of 2006 concerning Amendments to Government Regulation Number 32 of 1999 concerning Shari'a and Procedures for Implementing Penitentiary Rights, Republic of Indonesia Passenger Regulation Number 99 Year 2012 concerning Second Amendment to Government Regulation Number 32 of 1999 concerning Procedures for the Implementation of Correctional Citizens' Rights, Presidential Decree of the Republic of Indonesia Number 174 of 1999 concerning Remission, Decree of the Minister of Law and Legislation No. RI. M.09.HN.02.01 of 1999 concerning Implementation of the Presidential Decree of the Republic of Indonesia Number 174 of 1999 concerning Remission, and Decree of the Minister of Law and Legislation No. RI. M. 10.HN.02.01 of 1999 concerning Delegation of the Authority to Grant Special Remissions. Constraints found in the Implementation of Remission in the Correctional System as the Granting of Prisoners' Rights at the Class II A Women's Penitentiary Institution in Malang are seen from 3 components of the legal system, namely: 1) Legal Structure, Legal Substance and Legal Culture
