- The title of this thesis is the Legal Protection of insurance policy holders in bankruptcy study decisions number 1016 K / Pdt.Sus-Pailit / 2016). Insurance is a form of risk transfer that might suffer because of an event, the insurer ties himself to the insured by obtaining a premium to provide compensation. In some insurance companies, they cannot pay debts to creditors until they are declared bankrupt. The formulation of the problem in this writing is how the legal protection of policyholders in bankruptcy, is the element of the principle of legal certainty, justice is fulfilled in bankruptcy assets in the example of the decision used by the author. The purpose of this paper is to find out the legal protection of bankrupt insurance policy holders. The method used in this writing is a normative juridical approach method. The results obtained in this paper are legal protection of the insurance policy holder in the perspective of bankruptcy of the creditor policyholder only as a concurrent creditor so that the last settlement is paid, the author's opinion should be taken to protect the rights of policyholders considering the revoked business permit. Suggestions for the need for confirmation in related legislation.
