It is time to identitias verificationi national legal done by means of putting its officials with the customary law, as the value of affecting the positive law. Sumpah Banyu Roto, as value and the law of adat in the community the tribe of tengger, is the value of and norma which have become guidelines daily life to keep the balance the community of tengger. Along with that, there is the renewal of a national criminal, having orientation to keep the balance and heal the state of and order. It is also an Sumpah Banyu Roto and he does not justify Kumpul Kebo, because is held in opposition to a norm / law the living so shown above. Therefore, this paper will discuss, first: how convergence between Sumpah Banyu Roto with the criminal on the RUU KUHP. Second, how the tribe Tengger contained in an Sumpah Banyu Roto related to a criminal acts of Kumpul Kebo.
