- Railroad is one of the modes of transportation that has special advantages in carrying large numbers of passengers. Besides that the railroad system in Indonesia is also increasingly advanced, this can be seen from the emergence of fast trains that help smooth transportation. Therefore, service and passenger satisfaction are needed in this case, referring to this, the author took a case study at PT Kereta Api (Persero) Gubeng DAOP VIII Surabaya as the object of study. This writing takes the formulation of the problem of how the responsibility of PT KAI (Persero) for passengers has resulted in the delay in the arrival of the train and the actions of PT KAI (Persero) in overcoming the delay in the arrival of the train. The purpose of this research is to find out the responsibility of PT KAI (Persero) in terms of the occurrence of train delays and what actions were carried out by PT KAI Persero in overcoming delays on trains. This study uses an empirical juridical approach. Juridical approach namely law is seen as the norm or das sollen. While the empirical approach is law as a social reality or das sein. Based on this research there are problems regarding the late arrival of the train, this certainly makes the passengers feel aggrieved due to inappropriate arrival time with the initial agreement. The form of PT KAI's responsibility in the event of a delay in providing compensation to passengers, but not all passengers get compensation because the compensation management process that is considered complicated and complicated makes the passengers silent their rights are not fulfilled. The factors causing train delays are divided into 2, which are due to overmacht factors and error factors in operation. PT KAI's actions in overcoming delays in implementing the Gapeka (Railway Travel Chart) system to be able to evaluate its performance during delivery and also minimize the occurrence of obstacles that can cause train delays.
