- This research is motivated by the absence of rules regarding sanctions for investigators who detain suspects beyond the time limit specified in the Criminal Procedure Code and the Criminal Procedure Code itself has not regulated the maximum period of the investigation process.This research discusses the issues related to the regulation of the suspended investigation of suspects from the perspective of the theory of legal certainty and the juridical implications of regulating the termination of investigations of suspects in terms of the theory of legal certainty.This research is a normative juridical study using a legislative approach that regulates investigations and conceptual approaches to find new conceptual concepts that should be regulated in the Criminal Procedure Code.Based on the results of the research and discussion, it was found that in carrying out the investigation process there were several interests, one of which was the interests or rights of suspects which should not be violated by law.The absence of regulations regarding sanctions for investigators who detain suspects beyond the time limit specified in the Criminal Procedure Code and arrangements regarding the maximum deadline for conducting the investigation process can lead to arbitrariness by the investigator which causes the rights held by the suspect to be violated.Therefore, the regulation regarding sanctions for investigators who detain suspects beyond the time limit specified in the Criminal Procedure Code and arrangements for the maximum deadline for conducting the investigation process must be regulated so that the law enforcement process can run fairly, does not harm any party and realize prosperity for the community.Then the law enforcement process in this case detention in the investigation must pay more attention to the Criminal Procedure Code to provide legal certainty and guarantee the rights of suspects.
