- Air transportation is preferred by the public with promising time efficiency compared to other means of transportation such as sea and land transportation. The large number of passengers who use transportation or air transportation services will automatically increase the number of aircraft passenger goods that are deposited in the checked baggage of the airline so that the possibility of the passenger passenger of the aircraft to experience loss of carrying luggage is getting bigger. The problems raised are: 1. What is the responsibility of the Garuda Indonesia airline if the passenger experiences loss of goods due to baggage handling errors by the airline, 2. What are the supporting factors and obstacles / obstacles for the airline in resolving passenger losses due to baggage handling errors. The research method used in this study is sociological juridical by finding facts, then identifying problems with solving problems with primary legal materials and secondary legal materials used including laws, books and related legal materials. Based on the research that has been carried out, the implementation of the responsibility of Garuda Indonesia applies the principle of fault liabillity which in realizing the compensation comes from the Minister of Transportation Regulation Number 77 of 2011 concerning the Responsibilities of Air Transport Carriers. Supporting factors refer to the theory of legal effectiveness, namely from the existence of legal factors, law enforcement factors, and facilities. Constraints faced by carriers are influenced by technical problems, lack of understanding of passengers regarding the procedure for filing claims for damage / loss of their checked baggage items and internal air transportation factors, in this case employees who are in charge of baggage cause losses to passengers of Garuda Indonesia airlines.
