- Application for bankruptcy statement from Financial Services Authority to PT. Asuransi Jiwa Bumi Asih Jaya in case of Register Number: 04 / Pdt.Sus-Pailit / 2015 / PN.Niaga.Jkt.Pst decided to reject bankruptcy application from Financial Services Authority because of debt from PT. Asuransi Jiwa Bumi Asih Jaya can not be proven simply so its contradictory with Article 8 paragraph (4) UUKPKPU considering that there is still a cassation process in the State Administration Court regarding the revocation of the insurance company license. The purpose of this research to know and review legal certainty in the verdict of the Central Jakarta Commercial Court Judges regarding simple proof of bankruptcy applications Financial Services Authority to PT. Asuransi Bumi Asih Jaya and to knowing whether or not claims for insurance benefits that have matured and can be billed are categorized as a debt. The research methods was using normatif legal research method, by using a method case approach, historical approach, conceptual approach, and statue approach. Based on the results of the study, The Panel of Judges of the Commercial Court has incorrectly applied the Law of the Judges to base the decision on inappropriate considerations of the subject matter which is the basis of the problem has linked the petition for bankruptcy statement to the State Administration. And then, Benefit Claims Insurance that has matured is an achievement that must be paid rising as a result of the engagement in a bankruptcy case PT Asuransi Jiwa Bumi Asih Jaya so that it can be said as a debt and becomes the basis for fulfilling the material requirements for the petition for a bankrupt statement as stated in Article 2 of UUKPKPU
