- Pratima theft in Bali lately often happens, it is often found only using formal Indonesian criminal law in its completion stage by not paying attention to the local customary criminal law. Though the perspective of customary law included in the Awig-awig related to the theft of pratima is very necessary, in order to give the best consideration in making decisions when imposing penalties and giving a sense of justice to the people of Bali. So that was found two formulation of the problem, namely, how criminal prosecution against perpetrators of the theft of sacred objects associated with traditional criminal law (Awig-awiq karma pakraman) and How the criminal policy in an effort menyelesaian theft of sacred objects (Pratima) in achieving a sense of justice of indigenous peoples Bali. The method used is a method socio-juridical, sanctions against perpetrators of theft sacral objects related to the Criminal Law of Indigenous(Awig-Awig Krama Pakraman) is against the perpetrators of thefts sacral imposed sanctions that Sangaskaradanda, Arthadanda, Kasepekang, the judge must also apply sanctions - sanctions beyond Article 10 of the Penal Code which is the application of criminal sanctions in the form of fulfillment of the obligations of indigenous or traditional criminal. The application of traditional sanctions against the perpetrators of the theft sacred objects in the environment law should be strengthened further. The draft is expected later in the draft - the new Criminal Code in addition to criminal sanctions there are also traditional sanctions sacral especially those thefts.
