- Until now the criminal case settlement process in Indonesia is still dominated by the presence of state courts, if criminal cases can be resolved outside the court then it is more effective and efficient. This can be done with the existence of Penal Mediation, especially in minor criminal cases such as mild abuse. The purpose of this study was to find out how the Penal Mediation process was carried out by Malang City Police in cases of minor persecution, and any obstacles faced by Malang City Police in conducting Penal mediation as an alternative solution to cases of minor persecution. The type of this research is a qualitative descriptive research with the research approach used is: Juridical Sociology (empirical). The data sources of this study are Visible Criminal Investigators and Malang City Police Investigators. Furthermore, the data collection methods used are interviews, documentation and search tracing. Furthermore, the data analysis used is qualitative data analysis. Based on the results of the research obtained regarding the Penal Mediation process carried out by Malang City Police in the case of a criminal act of minor maltreatment, referring to the circular letter of the Chief of Police of the Republic of Indonesia Number: SE / 8 / VII2018 dated 27 July 2018 concerning the application of restorative justice. Whereas the problem is that there can be a re-dispute between the parties being mediated and often cases of minor mistreatment which can lead to serious crimes when not immediately reported, and there are still some cases of minor maltreatment that have not been resolved with Penal Mediation, for which It is expected that in the future there will be a permanent and fundamental regulation and regulation in implementing Penal Mediation.
