- Absente/Guntai land ownership still exist and found in Temas of Batu City. This shows that related to the enforcement and control of land ownership there is still looseness or legal gap in the registration of licenses and behind the name of absente/guntai land ownership. This research use sociological juridical approach method, primary data source obtained from field result and from documentation and legislation as well as data collection technique in the form of field interview and field observation to location where absent land ownership in Temas Batu City as place of search and primary data collection then data result of research analyzed by descriptive qualitative. Based on the research to BPN/ATR Batu City and tenants absente/guntai land axisting obtained results land ownership absente/guntai status the owner of the land and passive in terms of management and land use evidence obtained from the minutes of landreform and book tax village with the result that land ownership absente/guntai in Temas, Batu city can be registered application land registry. Need to increase the supervision and prosecution firmer structure
