- The occurrence of a criminal act has 2 (two) parties involved in it, namely the Actor and the Victim, in which the perpetrator and victim have their respective roles. But in the case of this study the author takes the formulation of the problem about how the role of the victim against the crime of abuse that befell the victim and whether in the court the victim has obtained legal protection in accordance with the existing provisions. This study uses a method of sociological empirical approach, primary data sources in the case of criminal cases of mistreatment and secondary data sources are obtained from the laws and data collection techniques and interviews with investigators or the Malang City Police. Then the results of the interview data were analyzed qualitatively qualitative. Based on the results of research or analysis of 3 (three) cases of criminal acts of persecution that have been reviewed have various factors, namely: a. Because the victim is affected by liquor b. Because of lack of insight or negligence of the victim itself c. Lack of moral education and lack of ethics that the victim has. In conclusion, the occurrence of a crime of mistreatment that is not entirely due to the role of the perpetrator, but because of the role of the victim who caused the crime of the persecution. Suggestion, It is better if the community does not behave which can lead to a criminal act and the need for socialization counseling from the relevant law enforcement agencies.
