  • Lately, the sexual violence against children in Indonesia is so widespread. Through sodomy, rape, even not infrequently in cases of sexual crimes against children (pedophiles) that led to the act of murder. With so many cases, the government finally gave serious attention to the amendment of the protection law to be given a law worthy of the perpetrators. Kebiri is a punishment that is considered effective and members deterrent effect. Based on the official records of the ILO (International Labor Organization) and strengthened by UNICEF (United Nations Children's Fund) in Indonesia the number of children who became victims of sexual crime crimes reached 70,000 people each year and of that 21,000 of them are on the island of Java. With the support of the government for the enactment of the punishment for the pedophile, the authors want to examine it from the perspective of the Majelis Ulama Indonesia (MUI) and the Majelis Tarjih Muhammadiyah. What are the views of the two assemblies regarding the enactment of the punishment of the elders for the perpetrators of sexual crimes against children (pedophilia). The type of research used is empirical research of character study. The type of data used is primary and secondary data. Data collection techniques by interview and documentation related to the topic or title of research. The data that have been collected than in the analysis, the results of field research with existing data, in the analysis, to be taken a conclusion. The conclusion is: a. punishment of unknown Cabiri in Islamic law b. punishment for perpetrators of sexual crimes in Islam is very heavy because of this some scholars argue equated with adultery c. equality and disagreement in establishing or taking the constitutional courtesy of cases of sexual violence which the government punishes by castrated.
