  • This study is intended to analyze the executionof BNN duties in preventing and eradicating narcotics abuse, narcotics illicit trade and narcotics precursors through both penal and non-penal approaches.The focus of problems being studied are: Whether non-penal efforts in handling narcotics abuse by BNN can be implemented in Malang; What are the forms of non-penal efforts in handling narcotics abuse done by BNN Malang; and What are the obstacles faced by BNN Malang in performing non-penal effort against the narcotics abuse. This study employed Sociological Juridical Approach and was conducted at BNN Malang. The primary data were collected from the field through interview while secondary data were gathered from the legislation through literature study and legislation review. The data were analyzed by using qualitative descriptive technique. According to the data obtained from three interviewees, the result shows that non-penal efforts are indispensable and can be implemented in Malang since it is in line with the main program of BNN Malang called as P4GN (Prevention and Eradication of Narcotics Abuse and Illicit Trade). The forms of non-penal efforts performed by BNN Malang are: a. Developmental advocacy of anti-narcotics insight; b. Empowerment of anti-narcotics; c. P4GN information; and d. Empowerment of anti-narcotics program. The obstacles faced by BNN are: 1. Thecommunity is less responsive 2. The district government response is slow. Suggestion: Both community and government role are indispensable for the success of BNN in performing non-penal efforts to minimize narcotics crime.
