- This study analyzing about the implementation of terms about determination of defendant in narcotics crime as a dealer and/or abuser by The Public Prosecutor. As for the problem to be researched consist of the effective aspect in the implementation of article III by The Public Prosecutor and law implication if there is a mistake in the indictment or claim that conducted by The Public Prosecutor. The writer using Normative Legal Research as the method for the three decisions number 446/pid.sus/2016/pn.mlg jo no 2199k/pid.sus/2012 jo no 1174/pid.sus/2012, with primary material, that analyzed using case approach and juridical analysis. The result of this research is The Judiciary have lack of carefulness in applying the indictment and claim article III because The Prosecutor cannot prove the element of possessing, having, and controlling, in case of proving these elements The Prosecutor must know the purpose and objectives of controlling the drugs by the defendant. Incorrect demands by the prosecutor implicate to The Judge’s verdict that deciding beyond The Prosecutor’s demands. The writer concludes that demand and claims by The Public Prosecutor is not effective because The Prosecutor cannot prove the elements of article III. The writer suggests The Public Prosecutor in making the indictment must be careful and precise to see the existing evidences and The Public Prosecutor should be more professional in doing their duties and represent the result of their investigation.
